We know America can be the home of some frivolous lawsuits, but this one might take the cake.
Jennifer Connell, a 54-year old woman from Manhattan, is reportedly suing her 12-year nephew Sean Tarala for breaking her wrist in an incident that happened four years go. Connell was attending young Sean’s 8th birthday party when an over excited hug led to the injury.
The boy had gotten his first two-wheeler for his birthday, and was joyfully riding the bright-red bike around and around the home, according to testimony.
But when he spotted Connell, he dropped the new bicycle on the ground, exclaiming, “Auntie Jen, Auntie Jen.”
“All of a sudden he was there in the air, I had to catch him and we tumbled onto the ground,” Connell testified of her encounter with the 50-pound boy. “I remember him shouting, ‘Auntie Jen I love you,’ and there he was flying at me.” (Via CTPost)
She claims she didn’t tell anyone that she was hurt at the time, because she didn’t want to ruin the birthday party. Instead she is now suing for $127,000, claiming that Sean was “negligent” and “careless” and caused her serious injuries and losses.
“I live in Manhattan in a third-floor walkup so it has been very difficult,” Connell said Friday at Connecticut Superior Court. “And we all know how crowded it is in Manhattan.”
“I was at a party recently, and it was difficult to hold my hors d’oeuvre plate,” she added.
Oh, the humanity.
Connell also testified that although she loves Sean, and described him as “very loving” and “sensitive,” but believes he needs to be held accountable. We’re not sure where this woman thinks a pre-teen boy is going to find six-figures to pay up if she wins, but hey, ‘Murica!
A jury took just 25 minutes to decide in favor of the nephew. Connell exited the courthouse, escorted by security, without making any comment to the assembled media.
